Terms of Service

1. Acceptance of Terms

By creating an account or using JobTally ("the Service," "we," "us"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

JobTally is a job-tracking and estimate-building tool for trade contractors. It allows you to create jobs, build itemized estimates, generate shareable links for clients to approve or decline estimates and change orders, and track a job's history over time.

3. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at jobtallyapp@gmail.com if you suspect unauthorized use of your account.

4. Subscription Plans and Billing

JobTally offers a Free plan and paid monthly subscription plans (currently Solo and Crew; an Enterprise plan is planned for the future). Paid plans are billed monthly in advance. Payment is processed by Paddle.com Market Limited, acting as our authorized reseller and merchant of record; JobTally does not directly collect or store your payment card details.

The Free plan is limited to a maximum number of active jobs as described on our pricing page. We may adjust plan features, limits, and pricing at any time, with notice provided on our website for material changes to paid plans.

5. Cancellation

You may cancel your subscription at any time from your account settings or by contacting us. Cancellation stops future billing. See our separate Refund Policy for details on what happens to your access after cancellation.

6. Client Data You Submit

JobTally allows you to enter contact information (such as name, phone number, email address, and site address) about your own clients in order to build and send them estimates and change orders. By submitting this information, you represent that you have the right to share it with us for this purpose and that you are responsible for your own compliance with any obligations you have to your clients regarding their personal information.

7. Acceptable Use

You agree not to use JobTally for any unlawful purpose, to misrepresent your identity or business, to attempt to access other users' accounts or data, or to interfere with the operation of the Service.

8. Intellectual Property

You retain ownership of the job, client, and estimate data you enter into JobTally. We retain ownership of the JobTally software, design, and branding. You grant us a license to store and process your data solely for the purpose of providing the Service to you.

9. Disclaimer of Warranties

JobTally is provided on an "as is" and "as available" basis. We do not guarantee the Service will be uninterrupted, error-free, or suitable for any particular purpose. You are responsible for verifying the accuracy of estimates, prices, and totals before sending them to clients.

10. Limitation of Liability

To the maximum extent permitted by law, JobTally and its operator will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to lost business, lost profits, or disputes with your clients.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may stop using the Service and delete your account at any time.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of Israel, without regard to conflict-of-law principles.
